Copyright & Usage Terms 1. Copyright Ownership All photos, videos, floor plans, and media created by OC Premier Media are protected by U.S. copyright law. OC Premier Media retains full copyright to all Media unless otherwise agreed in writing. 2. License Granted to Client (Commercial Use) Upon full payment, the client is granted a non exclusive, non transferable, perpetual commercial license to use the Media solely for marketing and promoting the specific property and the client's real estate services. - Permitted uses include MLS, property websites, print and digital ads, email marketing, social media, and other standard real estate marketing channels. - The license may not be resold, gifted, or sublicensed to third parties (such as builders, stagers, designers, or other agents) without written permission and/or additional licensing fees. - This license applies to all Media types, including photography, video, aerial imagery, 3D tours, floor plans, twilight photos, and social media reels. 3. Photographer's Right to Use Media (Portfolio & Marketing) OC Premier Media retains the right to use any Media created for the client for our own marketing and promotional purposes, including but not limited to: - Our website and online portfolio - Social media accounts - Printed and digital marketing materials - Industry competitions or publications If a property or homeowner requires limitations on this use, this must be requested in writing before the shoot and may affect pricing and/or availability. 4. Edits, Alterations & Filters Media may not be significantly altered, re-edited, or have additional filters/effects applied in a way that misrepresents the property or degrades image quality without our written consent. Cropping and minor adjustments for layout are allowed. 5. No Unauthorized Distribution Third parties (including builders, architects, stagers, decorators, vendors, or other agents) must obtain their own license from OC Premier Media before using the Media in any form. Sharing files with third parties does not transfer rights of use. 6. Refunds, Reshoots & Cancellations (Summary) - Payment is due as stated in your invoice and is required for usage rights to begin. - Cancellations / Reschedules within 24 hours of the appointment may be subject to a fee. - If there is an error caused by OC Premier Media, we will make reasonable efforts to correct it or reshoot as needed. Weather, property readiness, and staging are the client's responsibility. 7. Model & Property Releases The client is responsible for obtaining all necessary permissions from property owners, tenants, and any persons appearing in the Media. By booking, you confirm that you have authority to grant access to the property and use imagery for marketing purposes. 8. Acceptance of Terms By placing an order, you acknowledge that you have read, understand, and agree to these Copyright & Usage Terms, as well as any additional terms posted on our website.
